While it is intentional, it should not be intentional that you entirely base a look on something else to the point where you copy every line on their face.
Using a reference is common, so I see it more as: you can use a reference photo for your painting, but don’t use one everyone knows.
or use it as a REFERENCE rather than a direct rip-off. I use references all the time (for lighting or pose or whatever) but never just paint the reference picture and claim it as my own.

It’s not EXACTLY the same! Tyber Zann has a honkin’ huge scar across his face and Lucius Malfoy doesn’t. Too bad it wasn’t intentional, otherwise it would have been so much better.
