James Galvin Framing, Inc. apparantly does not comprehend the meaning of the little circle with the “R” inside it.
He may be in the clear because he changed the logo ever so slightly (big lump-hammer to a claw hammer). Kinda like that company that makes the shirts and stuff that say “cocaine” in the Coca Cola script, with the “dynamic ribbon device” (the official name for the “swoosh”)
Those places still get sued… if you can track them down. If it’s enough to cause confusion – you’re at fault.

The logo on the vehicle uses a framing hammer, so my guess is that they just stole the Arm & Hammer logo, but modified it slightly. Anyway, the Better Business Bureau doesn’t seem to mind. Whoa… BBB. I never thought that coincidence would come up on this site.
BBB has nothing to do with trademark infringement.
Of course the Arm and Hammer logo is a ripoff of the Socialist Labor Party of America (really!).

First use of the Arm and Hammer logo by Church and Dwight (makers of Arm and Hammer Baking Soda): 1878. It was based on an earlier logo for Vulcan Spice Mills, however neither logo was as similar to the SLPA logo as the modern version of A & H logo.
Hammers were a popular motif for various purposes through time. The surprising fact is not the use of an arm holding a hammer (which can be found in any number of other logos in the 19th C. and before), but the striking similarity of these two logos.
FYI- both logos are based on the symbol of the Socialist Labor Party of America (SLP).

I had to really enlarge my display after reading your post to even be able to read that.
And in case your geography is a little rusty, it says “CENTRAL TEXAS” on the Better Business Bureau logo.

Definitely Austin. And I KNOW those yahoos. They ain’t worth a flip. Never mind the fact that they STOLE their logo. No self-respecting business would steal a logo from a national brand. (Or any other for that matter!) And they claim BBB membership….. Yeah, right.
Maybe not enough for a trademark infringement charge to stick. Since the business of this firm is completely different A&H. One is a framing firm the other home cleaning and other household products. The hammer is different, etc.
Yes, they are similar, but not enough to “cause confusion” or “dilute the value of the existing trademark”, the typical legal standards for infringement.
